Roads and Maritime Services is a NSW statutory authority established on 1 November 2011 under the Transport Legislation Amendment Act 2011. Roads and Maritime brings together the former Roads and Traffic Authority (RTA) and NSW Maritime Authority.

Legislation - Minister for Roads and Freight

The administration of individual Acts is allocated to Ministers by an Allocation of the Administration of Acts instrument under the Constitution Act 1902. This is updated and amended from time to time. Administration of an Act extends to the administration of any Regulations made under the Act.

As at 1 July 2014, Acts administered by the Minister for Roads and Freight are:

Consolidation of NSW road transport legislation

The Government is committed to reducing red tape. This includes cutting the number of pieces of legislation on the statute books and limiting their regulatory impact on business and the community.

To support this, laws which govern driver licences, vehicle registrations, road rules and related matters have been consolidated. The new, streamlined legislation will remove anomalies, inconsistency and a degree of complexity.

From 1 July 2013, the Road Transport Act 2013 replaced four Acts:

  • Road Transport (Vehicle Registration) Act 1997
  • Road Transport (Driver Licensing) Act 1998
  • Road Transport (Safety and Traffic Management) Act 1999
  • Road Transport (General) Act 2005

Heavy vehicle matters will remain confined to the Road Transport (Vehicle and Driver Management) Act 2005 until later this year when the Heavy Vehicle National Law is adopted in NSW. There are also some changes to the number and structure of road transport regulations.

The new structure of road transport legislation will have little impact on the majority of road users and Roads and Maritime clients. There are no changes of policy and no new offences however the new legislation may improve NSW road users’ understanding of their legal rights and responsibilities.

For specialists such as the Police, Courts and public sector the streamlined structure will aid understanding, cut the amount of time taken to navigate the law and reduce errors of interpretation.
